The list of Italian Stop 5G administrations is growing in awareness of social and health risks. Some sixty regions, autonomous provinces and municipalities are questioning the darker aspects of 5G. As in Belgium (federal region of Brussels) and Switzerland (three cantons), a moratorium has also been established in Italy and 14 municipalities have already approved Stop 5G City Council resolutions or motions.

Fifth Court in Italy Ruled Cell Phones Cause Cancer and Determined It Is An Occupational Disease
On 30 January, 2019, an Italian Court in the city of Monza, Italy ruled that the Acoustic Neuroma brain tumor of an airport employee was caused by exposure to the radiation from a cell phone he used for over 10 years for his work. The court determined that the tumor has permanently incapacitated him, and ruled it to be an occupational disease. PRESS HERE for the Court’s Decision.
This is the fourth case in which the courts in Italy determined that an Acoustic Neuroma type brain tumor was caused by a cell phone, and the fifth court to make such ruling as in the first case the court decision was appealed and later confirmed by Italy’s Supreme Court. A Summary of the four cases is in the bottom of this article.
The importance of the decision is not only that it’s another Italian Court decision that establishes the link between brain tumors and exposure to Radio-Frequency/Microwave Radiation that is emitted from cell phones, but also by recognizing that if the exposure to electromagnetic radiation (EMR) was necessary for the purposes of work, the Acoustic Neuroma tumor may be considered an Occupational Disease.

Acoustic Neuroma, also known as Vestibular Schwannoma is a tumor which develops on the main nerve leading from the inner ear to the brain. This nerve influences balance and hearing, and pressure from an acoustic neuroma can cause hearing loss, ringing in the ear, and unsteadiness. Occasionally, it can interfere with brain functioning. It is a schwannoma type of cancer which means it develops on the Schwann cells covering the nerve.
It is important to mention that in the National Toxicology Program study of the US Federal government, the tumors that were found to be caused by exposure to cell phones’ radiation are schwannoma type cancers.
The Case
From 1994 to 2010, an airport employee was exposed at his work to high levels of Radio-Frequency and Microwave radiation from a variety of antennas and high-frequency equipment: altitude signal repeaters, weather radars, satellite antennas, and airplane equipment.
In addition, for the purpose of the coordination of tasks which were part of his job in the office, he had to use a lot of Electromagnetic frequencies and radiation emitting devices such as mobile phones, two PCs that were always on, and signal repeaters (GSM and DECT).
Several times the employee and his colleagues reported to the employer that the levels of electromagnetic fields (EMFs) and radiation were high and requested that the EMFs and radiation be measured, but they were ignored.
The employee used a Siemens DECT phone, a Nokia and later a Samsung cell phone for more than four hours a day, with phone sessions of up to 45 minutes consecutively and on the left side of his head. In 2010, he was diagnosed with an acoustic neuroma.
In 2011, the employee was declared to be permanently unfit for work and his disability was determined to be 68%. In 2014, he applied to INAIL (the Italian Center for Occupational Diseases) asking that his tumor be recognized as an Occupational Disease. The employee claimed that there is a casual link between his exposure to radiation in his work and the acoustic neuroma cancer he suffered, and hence his disease should be recognized as an occupational disease.
The CTU, a collaboration of experts and technical advisers assigned to evaluate the case, conducted research into the disease and its risk factors. In reducing the criteria for the causal link assessment, the CTU stated that the worker had been exposed to high-frequency EMR for a considerable number of hours per day for over 10 years.
The CTU concluded that the development of the left auditory nerve neuroma is related to his work. They based their determination on the duration of exposure, the type of devices he used, the type of pathology, and the review of the literature. They determined that the evidence is sufficient for a causal link, even in the absence of clear conclusive scientific evidence.
The CTU also refereed to a similar decision by the Court of Brescia, in which several studies between 2005 and 2009 were quoted. In three of the studies that were quoted, the risk of Neuroma had increased considerably, while according to another study the risk was considered to be low but present.
The CTU concluded that the tumor caused a reduction in the employee’s psycho and physical integrity.
Summary of Previous Italian Court Decisions
First Decision: Brescia Court. December 10, 2009, affirmed by Italy’s Supreme Court on October 12, 2012
The Supreme Court of Italy has affirmed a ruling that granted worker’s compensation to a businessman who developed a tumor after using a cell phone for 12 years. Marcolini, a financial manager at an industrial plant in Brescia in northern Italy, used cell and cordless phones for five-to-six hours a day for 12 years. He was diagnosed as having a benign tumor on the trigeminal nerve, which controls facial muscles and sensations. The court ignored industry funded studies and declared them to be biased and preferred Prof. Lennart Hardel’s expert opinion.
Second Decision: Ivrea Court. March 30, 2017
The Court of Ivrea recognized a causal link between inappropriate use of a mobile phone and a brain tumor. Roberto Romeo, 57, used his mobile for three to four hours of each working day for 15 years. He was diagnosed in 2010. His Acoustic Nerve had to be removed.” A medical expert estimated the damage to Romeo at 23 per cent of his bodily function, prompting the judge to make a compensation award of 500 euros per month to be paid by INAIL, a national insurance program covering workplace accidents. Newsweek mistakenly reported this case as the first decision while it was already the second.
Third Decision: Florence Court: April 2017
The court ordered Inail (National Institute for Accident Insurance at Work) to compensate a salesperson who developed Acoustic Neuroma. A worker used the phone for 2-3 hours a day for 10 years. The experts opinion was that there is a “high probability of connection between cell phone use and malignant tumors”. The Court of Florence recognized the connection between the use of the cell phone and the onset of an acute nerve disease.

Italy - For 5G the emission limits must be uniform to those of the EU

Italy - Health risks arising from mobile phone misuse: government ordered to launch information campaign
The debate regarding the health risks connected to the incorrect use of mobile phones has recently been rekindled in Italy. With a 15 January 2019 decision, the Lazio Regional Administrative Court (TAR Lazio) ordered the Ministry of Environment, the Ministry of Health and the Ministry of Education, Universities and Research to launch an information campaign to advise the public about the potential health and environmental risks arising from the misuse of mobile and cordless phones.
The ministries had been sued before the TAR Lazio by the Association for the Prevention of and Fight Against Electrosmog (APPLE), established to promote the protection of health and the environment from exposure to electromagnetic fields.
APPLE's action was grounded on Law 36/2001 on the protection from exposure to electric, magnetic and electromagnetic fields. In particular, the claimant referred to Article 10 of the law, according to which the ministries should have promoted information and environmental education campaigns. APPLE's action highlighted the ministries' unjustified inactivity in this regard.
In order to support its claim and highlight the urgent need of the above information and environmental education campaigns, APPLE filed a number of scientific studies showing that the misuse of mobile and cordless phones could have harmful effects on human health due to exposure to electromagnetic fields, especially for children whose psychophysical development may be negatively affected.
The TAR Lazio's decision acknowledged the existence of a note issued by the Ministry of Health in 2012 in response to a previous request submitted by APPLE, whereby the latter was informed that an information campaign was being prepared. In particular, the ministry specified that:
- the issue concerning possible health risks arising from the use of mobile phones was already under review, particularly following the International Agency for Cancer Research's classification of electromagnetic fields as being possibly carcinogenic to humans (category 2B); and
- in 2011 the Higher Health Council recommended that an information campaign be conducted to promote the safe and responsible use of mobile phones, especially for children who are exposed to such devices at an increasingly early age, maintaining that the hypothesis of a causal relationship cannot be completely excluded in relation to the frequent use of mobile phones and cancer, despite no scientific certainty in this regard.
As the information campaign announced in 2011 had yet to be implemented, TAR Lazio ordered the government to launch such a campaign within six months from the service of the decision in order to advise the public about:
- the correct use of mobile and cordless phones; and
- the potential health and environmental risks arising from the misuse of such devices.
The TAR Lazio's decision, which received considerable media coverage, will most likely renew the debate about electromagnetic pollution and mobile phones.
Indeed, Italian courts have already faced the issue of the possible existence of a causal link between mobile phone use and cancer. In 2017 the Court of Ivrea and the Court of Florence recognised the damage caused by the extensive work-related use of mobile phones and ordered the national insurance provider (INAIL) to compensate the affected workers with a lifelong payment.
The courts were following in the footsteps of the Italian Supreme Court, which in a 2012 landmark case brought by a worker against INAIL, had ruled that a causal link exists between mobile phone use and cancer, holding that the benign tumour that the plaintiff had developed on the left side of his face (allegedly due to the use of a mobile phone for approximately five to six hours a day) entitled him to 80% of a disability pension.
In light of the information campaign that looks set to be launched in the next six months, mobile and cordless phone manufacturers should carefully review, as a precautionary measure, product information and warnings that they provide to consumers.

Florence Italy will use the precautionary principle for the rollout of 5G

Italian Court Orders Government to Launch Cell Phone Radiation Awareness Campaign
An Italian court has ordered the government to launch a campaign to advise the public of the health risks from mobile and cordless phones to begin by July 16. A citizens group called APPLE(Association for the Prevention of and Fight Against Electrosmog) sued to force the government to act. A joint press release between the Ministry of the Environment, Education and Health on the decision states the three ministries “welcome the judicial decision, convinced of the need to raise awareness on the issue and to promote prevention measures.”
In a breaking news report from Microwave News on the decision, Stefano Bertone who is helping represent APPLE, stated, “This case has important implications not only in Italy, but worldwide. At the moment, health and safety information is contained —or, I should say, buried— in cell phone manuals. This is not good enough. If it was, the court would have agreed with the government that sufficient information is already available.”
The New York Times AP reported the story in “Court orders Italian govt to publicize cellphone risks”and also cited a 2017 Italian court of Ivrea ruling that long-term use of a company-issued cell phone caused Telecom employee, Roberto Romeo’s non-cancerous brain tumor. In 2012 the Italian Supreme Court ruled that the National Institute for Workmen’s Compensation must compensate Innocente Marcolini, a 60-year-old retired businessman for his tumor due to long term cell phone use.
Over twenty countries have explicit health advice to the public to lower cell phone radiation exposure. France has issued several campaigns over the years educating their public on safer ways to use technology.

2016: Mayor of Borgofranco d’Ivrea ordered Wi-Fi to be turned off in schools. “Mayor Livio Tola told the town’s high school and elementary school to return to using cables to connect to the internet after reading that the electromagnetic waves given off by wireless routers were especially harmful to young children.”

2015: State Parliament of South Tyrol voted to confirm the precautionary principle: The State Government was mandated:
- To replace existing wireless networks whenever possible with networks that emit less radiation at schools, preschools, hospitals, nursing homes, and other public facilities.
- Establish a working group whose mandate it is to assess these new technologies and their exposure levels. With regard to wireless communication technologies, mobile Internet access, and public health, the working group shall clarify which technologies emit less radiation and provide sustainable technology options and
- To start an education and awareness campaign that informs about possible health risks, especially regarding the unborn, infants, children, and adolescents and that develops guidelines for a safer use of cell phones, smartphones, and Wi-Fi.

2012 Italian Supreme Court Ruling: Man’s brain tumor was caused by his cell phone use.

Lecce, Italy, “Istituto Comprensivo Alighieri- Diaz” School banned wifi: Their two resolutions decided:
- To ban wifi in school and install a wired system for the use of internet and reject the request of the local government (Municipality) to install an antenna on the school roof for the wireless signal providing for the “Wireless city” program.
- The resolution also asks the Municipality to install the antenna at a reasonable distance from school.
The Piemonte Region Council adopted a resolution to limit EMF exposure by limiting the use of wifi in schools and be considerate to the problem of EHS people.

The Italian Society for Preventive and Social Pediatrics has officially called to prohibit cell phones for children under 10 years old.

2016 – Turin Mayor Chiara Appendino laid out plans “to cut back on Wi-Fi in state schools and government buildings over concerns that radiation might damage people’s health”.
